A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.

The situation stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her order, the court pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
